Terms of Service

1. Acceptance of Terms

By accessing or using WhaleGram ("Service"), available at whalegram.li, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all users of the platform.

2. Description of the Service

WhaleGram is a performance advertising platform for Telegram that allows advertisers to create campaigns (join channel, join group, visit link, etc.) funded with credits purchased via USDT on the TON blockchain.

3. Eligibility

To use WhaleGram you must:

• Be at least 18 years old (or the minimum age required in your jurisdiction to enter into contracts).
• Have a valid Telegram account.
• Not be located in a jurisdiction where using this Service is prohibited.

4. Accounts and Authentication

Authentication is performed exclusively via Telegram. You are responsible for maintaining the security of your Telegram account. WhaleGram is not liable for any loss resulting from unauthorized access to your Telegram account.

5. Credits and Payments

• Credits are purchased via USDT on the TON blockchain.
• All credit purchases are final and non-refundable. Once a payment is confirmed on-chain, no refund can be issued under any circumstances, regardless of whether the credits have been spent.
• Credits have no cash value outside the platform and cannot be transferred between accounts or redeemed for any currency or asset.
• By completing a purchase you acknowledge and accept this no-refund policy.

6. Prohibited Conduct

You agree not to:

• Create campaigns for illegal content, scams, phishing, malware distribution, or content that violates Telegram's Terms of Service.
• Attempt to manipulate, reverse-engineer, or exploit the platform's credit or verification systems.
• Use automated tools or bots to artificially inflate campaign metrics.
• Resell or transfer credits for real-world currency outside of any official mechanism provided by WhaleGram.

Violation of these rules may result in immediate account suspension and forfeiture of credits without refund.

7. Advertiser Responsibilities

As an advertiser, you warrant that:

• All campaign targets (channels, groups, links) are owned by you or you have permission to promote them.
• Campaigns comply with Telegram's Terms of Service and all applicable laws.
• Campaign content does not promote illegal activities, hate speech, violence, or adult content.

WhaleGram reserves the right to pause, reject, or cancel any campaign at any time without refund if it violates these Terms. Credits allocated to a cancelled campaign are forfeited.

8. Intellectual Property

All WhaleGram branding, logos, and software are the property of WhaleGram. You may not copy, reproduce, or create derivative works without our written consent. You retain ownership of any content you create (e.g. campaign names, descriptions).

9. Disclaimers and Limitation of Liability

The Service is provided "as is" without warranties of any kind. WhaleGram does not guarantee that campaigns will achieve specific growth targets or that the Service will be uninterrupted or error-free.

To the maximum extent permitted by law, WhaleGram's total liability for any claim arising from use of the Service is limited to the amount of credits you purchased in the 30 days preceding the claim.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time from the Account & Privacy section within the platform. Upon termination, any remaining credits are permanently forfeited. No refund will be issued. For account-related issues, contact us via the details in Section 13.

11. Changes to Terms

We reserve the right to update these Terms at any time. We will notify users of material changes by updating the date above. Continued use of the Service after changes constitutes acceptance.

12. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes will be resolved through good-faith negotiation; if unresolved, through binding arbitration.
